Privacy Policy

Evidence Tracker ("we", "us", "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, and protect information when you use the Evidence Tracker mobile application ("the App"). We comply with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) and applicable state and territory legislation.

1. Information We Collect

Account Information: When you create an account, we collect your email address and display name. If you sign in via Google, we receive your Google account email and profile name as authorised by you.

Evidence Data: The App allows you to capture, store, and organise evidence including photographs, documents, voice recordings, text notes, calendar entries, financial records, and parental logs ("Evidence Data"). This data is stored locally on your device and, if you enable iCloud backup, in your personal iCloud account.

Usage Data: We collect anonymous, aggregated usage analytics (e.g., feature usage frequency, crash reports) to improve the App. This data cannot be used to identify you personally.

Email Data: If you connect your Gmail account, the App accesses email metadata and content solely for the purpose of importing emails you select as evidence. We use the Gmail API with read-only scope (gmail.readonly) and access only the messages you explicitly choose to import.

2. How We Store Your Data

On-Device Storage: All Evidence Data is stored locally on your device using an encrypted SQLite database. We do not maintain copies of your Evidence Data on our servers.

iCloud Backup: If you enable iCloud backup, your Evidence Data is stored in your personal Apple iCloud account. This data is protected by Apple's encryption and security measures. We do not have access to your iCloud account or backups.

Google Drive: If you choose to back up to Google Drive, files are stored in your personal Google Drive account under the app-specific folder. We use the drive.file scope, meaning we can only access files created by the App — not your other Drive files.

3. AI Processing

The App offers an optional AI-assisted court readiness review feature powered by Anthropic's Claude API. When you use this feature:

  • Selected evidence text and metadata is sent to Anthropic's API for processing
  • Data is transmitted over encrypted connections (TLS 1.2+)
  • Anthropic does not store your data after processing your request, in accordance with their data retention policy for API usage
  • Anthropic does not use your data to train their AI models
  • You can use the App without enabling AI features — they are entirely optional
  • No images, audio recordings, or file attachments are sent to the AI — only text content you explicitly submit for review

4. How We Use Your Information

We use your information solely for the following purposes:

  • To provide and maintain the App's core functionality
  • To authenticate your account
  • To enable iCloud and Google Drive backup (if activated by you)
  • To provide AI-assisted features (if activated by you)
  • To send you important service communications (e.g., security alerts)
  • To improve the App through anonymous usage analytics

5. What We Do Not Do

  • We do not sell your data. Your personal information and Evidence Data are never sold to third parties under any circumstances.
  • We do not share your data for marketing. We do not provide your information to advertisers or marketing companies.
  • We do not access your Evidence Data. Your evidence remains on your device and in your personal cloud accounts. We cannot read, view, or access it.
  • We do not use your data for training AI models. Data sent to the Anthropic API is not used for model training.

6. Third-Party Services

The App integrates with the following third-party services:

  • Apple iCloud: For optional device backup. Governed by Apple's Privacy Policy.
  • Google (Gmail & Drive): For optional email import and cloud backup. Governed by Google's Privacy Policy. We request only the minimum scopes required (gmail.readonly, drive.file).
  • Anthropic (Claude API): For optional AI-assisted features. Governed by Anthropic's Privacy Policy and API Terms of Service.

We do not use any third-party advertising, tracking, or analytics SDKs that collect personally identifiable information.

7. Data Security

We implement appropriate technical and organisational measures to protect your information:

  • Local data is stored in an encrypted SQLite database
  • Optional PIN lock and biometric authentication protect app access
  • All network communications use TLS 1.2+ encryption
  • Authentication tokens are stored securely in the device keychain
  • We conduct regular security reviews of our codebase

8. Data Retention

Your Evidence Data is stored locally on your device and remains there until you delete it. If you delete the App, locally stored data is removed with the App. Data in your iCloud or Google Drive backup persists in your cloud account until you delete it.

Account information (email address) is retained for as long as you maintain an account. If you request account deletion, we will remove your account information within 30 days.

9. Your Rights

Under the Australian Privacy Principles and applicable law, you have the right to:

  • Access: Request access to the personal information we hold about you
  • Correction: Request correction of inaccurate or incomplete personal information
  • Deletion: Request deletion of your account and associated personal information
  • Complaint: Lodge a complaint with the Office of the Australian Information Commissioner (OAIC) if you believe we have breached the APPs
  • Data Export: Export your Evidence Data at any time using the App's PDF export feature

10. Children's Privacy

The App is not directed at children under 18 years of age. We do not knowingly collect personal information from children. The App is intended for use by adults involved in family law proceedings.

11. International Data Transfers

When you use the AI-assisted features, text data may be processed by Anthropic's servers located in the United States. This transfer is necessary to provide the AI functionality and is conducted over encrypted connections. By using AI features, you consent to this transfer. All other data remains on your device or in your personal cloud accounts.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes through the App or via email. The "Last updated" date at the top of this policy indicates when the latest changes were made. Continued use of the App after changes constitutes acceptance of the updated policy.
