Terms of Service

These Terms of Service ("Terms") govern your use of the Evidence Tracker mobile application ("the App") operated by Evidence Tracker ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Important Disclaimer — Not Legal Advice

Evidence Tracker is not a law firm, does not provide legal advice, and is not a substitute for professional legal counsel.

The App is an evidence organisation and management tool. Any AI-generated suggestions, readiness reviews, or organisational features are provided for informational and organisational purposes only. They do not constitute legal advice, legal opinion, or legal representation.

You should not rely on the App as your sole source of guidance in legal proceedings. We strongly recommend consulting a qualified legal practitioner for advice specific to your circumstances. No solicitor-client relationship is created through use of the App.

The App's AI features may produce inaccurate, incomplete, or inappropriate suggestions. You are solely responsible for evaluating and deciding how to use any information or suggestions provided by the App in your legal proceedings.

2. Eligibility

You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Registration

You may be required to create an account to access certain features. You are responsible for:

• Providing accurate and current account information
• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account

4. Acceptable Use

You agree to use the App only for its intended purpose of organising and managing evidence for legitimate legal proceedings. You must not:

• Use the App to fabricate, falsify, or misrepresent evidence
• Use the App in connection with any unlawful activity
• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to circumvent any security features of the App
• Use the App to harass, threaten, or intimidate any person
• Upload content that contains malware, viruses, or harmful code
• Use the App in any manner that could damage, disable, or impair its functionality

5. Your Data and Content

You retain full ownership of all content and evidence you create, upload, or store using the App ("Your Content"). We do not claim any ownership rights over Your Content.

You are solely responsible for:

• The legality, accuracy, and appropriateness of Your Content
• Ensuring you have the right to capture and store any evidence you add to the App
• Maintaining backups of Your Content
• Complying with any court orders, legal obligations, or privacy laws relating to the evidence you collect

6. Subscriptions and Payments

The App offers free and paid subscription tiers. Paid subscriptions are billed through the Apple App Store or Google Play Store ("Platform").

• Subscription prices are displayed in Australian Dollars (AUD) and may vary by Platform
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage and cancel subscriptions through your Platform account settings
• Refunds are handled by the applicable Platform in accordance with their refund policies
• We reserve the right to modify pricing with reasonable notice
• Lifetime access applies to features available at the time of purchase and all future updates

7. AI-Assisted Features

The App includes optional AI-assisted features powered by third-party AI services (Anthropic Claude API). By using these features, you acknowledge and agree that:

• AI-generated content is provided for informational and organisational purposes only
• AI output may contain errors, inaccuracies, or inappropriate suggestions
• You are solely responsible for reviewing and verifying any AI-generated content before use in legal proceedings
• Selected text data is transmitted to third-party AI services for processing (see our Privacy Policy for details)
• We make no warranties regarding the accuracy, completeness, or fitness for purpose of AI-generated content

8. Intellectual Property

The App, including its design, code, features, and documentation (excluding Your Content), is owned by us and protected by Australian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App in accordance with these Terms.

9. Limitation of Liability

To the maximum extent permitted by Australian law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)):

• We provide the App on an "as is" and "as available" basis
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
• We are not liable for any loss or damage arising from your use of the App, including but not limited to loss of evidence, data corruption, or adverse outcomes in legal proceedings
• Our total liability to you for any claim arising from or related to these Terms or the App is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your breach of these Terms
• Your violation of any law or regulation
• Any content you submit, store, or transmit through the App

11. Termination

We may suspend or terminate your access to the App at any time if you breach these Terms. Upon termination:

• Your licence to use the App is immediately revoked
• You should export any data you wish to retain before termination takes effect
• Locally stored data remains on your device until you delete the App
• We will delete your account information within 30 days of termination

You may terminate your account at any time by deleting the App and contacting us to request account deletion.

12. Modifications to the App and Terms

We reserve the right to modify, update, or discontinue the App or any of its features at any time. We may also update these Terms from time to time. Material changes will be communicated through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Australia and the State of New South Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

Before commencing legal proceedings, you agree to attempt to resolve any dispute with us through good-faith negotiation by contacting us at support@evidencetracker.org.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Evidence Tracker regarding your use of the App and supersede any prior agreements.
